1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the Carinow platform (“Platform”, “we”, “us”, or “our”), which provides an online marketplace connecting individuals who own items (“Owners”) with individuals seeking to rent such items (“Renters” or “Users”).
By accessing or using the Platform, you acknowledge and agree that you have read, understood, and accepted these Terms. Carinow is not the owner, supplier, or provider of any items listed on the Platform and acts solely as an intermediary facilitating communication and rental transactions between Users.
2. Definitions
For the purposes of these Terms:
- “User” refers to any individual using the Platform, including both Owners and Renters.
- “Rental Items” means any item listed by an Owner for rental on the Platform.
- “Agreement” refers to the rental contract entered into directly between an Owner and a Renter.
3. Eligibility
- Users must be at least 18 years of age.
- Users must provide accurate, complete, and up-to-date personal information.
- Users must possess valid identification and a payment method acceptable in the United Arab Emirates.
4. Account Registration and Security
- Users are solely responsible for maintaining the confidentiality of their account credentials.
- Users accept full responsibility for all activities conducted through their account.
- Carinow shall not be liable for any unauthorized access to, or use of, any User account.
5. Platform Role and Disclaimer
- Carinow provides an online intermediary service that allows Owners to list items and Renters to rent items.
- Carinow does not own, operate, inspect, or control the Rental Items.
- Carinow is not a party to any Agreement between Users and has no control over the terms of such agreements.
- Carinow expressly disclaims any warranties or guarantees regarding the quality, safety, legality, or suitability of any Rental Items.
6. Rental Agreements
- All rental agreements are solely between the Owner and the Renter.
- Users acknowledge and agree that CariNow shall have no responsibility for:
- The condition, quality, safety, or legality of Rental Items;
- Any injury, damage, or loss incurred in connection with the use of Rental Items;
- The performance, availability, or timely return of Rental Items.
7. Payments and Fees
- Payments between Users may be facilitated by third-party payment processors integrated with the Platform.
- Carinow may charge service or transaction fees for the use of the Platform.
- Renters are responsible for any deposits, late fees, or damages as agreed directly with the Owner.
- Carinow shall not be liable for any payment disputes between Users.
8. User Obligations
Users agree to:
- Use Rental Items lawfully, safely, and in accordance with all applicable UAE laws and regulations.
- Return Rental Items in the condition in which they were received.
- Refrain from transferring, subleasing, reselling, or permitting third-party use of Rental Items.
- Resolve any disputes, claims, or complaints directly with the other User involved.
9. Limitation of Liability and Indemnification
- Carinow shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the Platform or Rental Items.
- Users agree to indemnify and hold harmless CariNow, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising out of or related to their use of the Platform or any rental transaction.
10. Cancellations and Refunds
- Cancellation, refund, and return policies are determined solely by the Owner.
- CariNow is not responsible for resolving disputes related to cancellations or refunds.
11. Termination
- Carinow may suspend or terminate any User account for violation of these Terms.
- Users may terminate their accounts at any time by contacting CariNow support.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
13. Amendments
Carinow reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of any revised Terms.
